1. Not an offer
This notice applies to all information about the ACFN franchise on our websites, in advertising and in other promotional materials.
The information on this website is for informational purposes only. It is not intended as an offer to sell, or the solicitation of an offer to buy, a franchise. An offer can only be made by a Franchise Disclosure Document (FDD) properly registered or filed with the appropriate state regulatory agency, or under an applicable exemption.
2. Registration states
Several states regulate the offer and sale of franchises, including California, Hawaii, Illinois, Indiana, Maryland, Michigan, Minnesota, New York, North Dakota, Rhode Island, South Dakota, Virginia, Washington and Wisconsin. If you live in one of these states, or the franchised business would operate in one, we will not offer or sell you a franchise until we have complied with that state's registration or filing requirements, or an exemption applies, and have delivered our FDD as that state's law requires.
New York residents: This advertisement is not an offering. An offering can only be made by a prospectus filed first with the Department of Law of the State of New York. Such filing does not constitute approval by the Department of Law.
Registration or filing of an FDD does not mean that any state recommends or endorses the franchise or has verified the information in the FDD.
3. Receiving the FDD
Under the Federal Trade Commission's Franchise Rule, you must receive our FDD at least 14 calendar days before you sign a binding agreement or pay any money to ACFN or its affiliates. Some states require delivery earlier. Please read the FDD and all agreements carefully, and consult a lawyer and an accountant before you invest.
4. Financial performance
We do not make any representation about the sales, income or profits a franchisee may achieve, except as stated in Item 19 of our current FDD. Company and network figures on our websites, such as cash dispensed, ATMs placed, franchisee counts and years in business, describe the ACFN system as a whole and are not a prediction of your results. Testimonials reflect individual experiences; your results will vary.
5. Canada
In Canadian provinces with franchise legislation, including Alberta, British Columbia, Manitoba, New Brunswick, Ontario and Prince Edward Island, a franchise is offered only by a disclosure document delivered as provincial law requires.
6. Independent ownership
ACFN franchises are independently owned and operated businesses. Franchisees are not employees, agents or partners of ACFN.
7. Questions
To request our current FDD or ask about franchise registration in your state, call (888) 444-2236 or write to us at 75 East Santa Clara Street, Suite 1450, San Jose, CA 95113.
